Affiliate Program Terms and Conditions

Plain English summary: You earn 30% recurring commission for as long as qualifying referrals stay subscribed and you remain an active affiliate in good standing. We pay monthly once you hit $50. Paid advertising is not allowed, whether it links directly to us or first sends people through another page. Don't spam or mislead people, and be honest about your affiliate relationship. 1. Introduction and Definitions
These Affiliate Program Terms and Conditions ("Agreement") govern your participation in the Copycat Cafe Affiliate Program ("Program"). By applying to or participating in the Program, you ("Affiliate", "you", "your") agree to be bound by this Agreement.
The Program is operated by Copycat Cafe Limited, a company registered in Cyprus (Company Number: HE 490235), with registered office at Arch. Makariou III, 56E, 2107, Nicosia, Cyprus, trading as "Copycat Cafe" ("Company", "we", "us", "our").
Key definitions:
- "Affiliate Link" means the unique tracking URL or code we provide to you
- "Commission" means the payment you earn for Qualifying Sales
- "Qualifying Sale" means a new subscription purchase made through your Affiliate Link that is not refunded within 30 days and did not originate from Paid Media
- "Customer" means a person who purchases a subscription through your Affiliate Link
- "Promotional Materials" means content you create to promote Copycat Cafe
- "Paid Media" means any placement or distribution for which you, or anyone acting on your behalf, pays money or provides other consideration to obtain traffic, clicks, impressions, placement, boosting, sponsorship, or promotion
- "Active Affiliate in Good Standing" means your affiliate account is approved, not suspended or terminated, and you are in material compliance with this Agreement
2. Program Enrollment
To participate in the Program, you must:
- Be at least 18 years old
- Submit a complete application through our affiliate platform
- Provide accurate information about yourself and your promotional methods
- Wait for approval (typically within 48 hours)
The Program is available worldwide except where prohibited by law or restricted by our payment providers.
We reserve the right to reject applications at our discretion. We do not accept applications from minors, or from websites that contain illegal, harmful, or objectionable content.
The promotional methods described in your application form part of these terms. If you materially change how you promote us, you must notify us before doing so. Notice does not make a prohibited method, including Paid Media, permissible.
3. Commission Structure and Payment
3.1 Commission Rates
- 30% recurring commission on all Qualifying Sales
- Commission is paid for as long as the referred Customer maintains their subscription and you remain an Active Affiliate in Good Standing
- Monthly plan: Approximately $8.70 per month per active subscriber (example based on current pricing)
- Annual plan: Approximately $52.20 per year per active subscriber (example based on current pricing)
- Note: Commission amounts may vary when promotional pricing is in effect
3.2 Cookie Duration
Your Affiliate Link uses a 60-day cookie. If a visitor clicks your link and purchases within 60 days, you receive credit for the sale.
3.3 Payment Terms
- Minimum payout threshold: $50 USD
- Payment schedule: Monthly, around the 15th of each month
- Payment methods: PayPal or bank transfer (for bank transfers, you may need to provide additional details)
- Availability: Payment methods and availability may vary by country. You are responsible for any transfer fees and for providing accurate payout details
- Currency: All commissions are calculated and paid in USD
3.4 Commission Adjustments
Commissions are subject to adjustment in the following circumstances:
- Refunds: If a Customer requests a refund within our 30-day guarantee period, the commission for that sale will be reversed
- Chargebacks: If a Customer disputes a charge, the commission will be reversed pending resolution
- Cancellations: Recurring commissions stop when the Customer cancels their subscription
- Fraud: Commissions from fraudulent or self-referred sales will be reversed
- Negative balance: If commission reversals exceed your earned commissions, the resulting negative balance will be carried forward and offset against future earnings. We will not invoice you for negative balances. If we have already paid commissions on transactions later refunded or charged back, we may recover those amounts by offsetting future commissions. No payouts will be made until your balance is positive.
We may withhold commission payments for up to 60 days while investigating suspected violations of these terms; withheld commissions are released if the investigation finds no violation.
4. Disclosure Requirements
This section is legally required. You must comply with all applicable advertising, consumer protection, and platform disclosure rules in every country where you publish or target promotional content.
4.1 General Requirements
Your relationship with Copycat Cafe must be obvious to the average person before they click your link or act on your recommendation.
- Affiliate content must be clearly identifiable as advertising or incentivized promotion
- Use clear labels such as "#ad", "Ad", "Advertisement", or "I earn a commission if you buy through my link"
- Avoid vague labels like "Affiliate link", "Partner", or "Thanks to Copycat Cafe" unless the commercial relationship is also clearly explained
- Disclosures must be prominent, easy to notice, and placed before or close to the affiliate link or recommendation
- Disclosures must not be hidden in hashtag clusters, footnotes, profile bios, terms pages, or behind "more" links
4.2 EU, Cyprus, UK, and US Requirements
If your content reaches audiences in the EU, Cyprus, the UK, the US, or any other regulated market, you must follow the applicable rules for that market, including rules on unfair commercial practices, misleading advertising, influencer marketing, and endorsements.
- For EU/Cyprus audiences, commercial intent must be clear and the promotion must not mislead consumers
- For UK audiences, follow ASA/CAP Code expectations for clear and upfront ad labeling
- For US audiences, follow FTC endorsement guidelines for clear and conspicuous disclosure
- When in doubt, use a plain-language disclosure at the start of the content and near the link
4.3 Social Media
When promoting on social media, use platform disclosure tools where available and clear labels such as #ad, Advertisement, or a plain-language commission disclosure. The disclosure must be visible without requiring users to click "more".
5. Acceptable Promotion Methods
5.1 Content Compliance
You are solely responsible for ensuring your promotional content complies with all applicable laws and these terms. We reserve the right to:
- Review any promotional content you create about Copycat Cafe
- Request modifications to content that misrepresents our product or violates these terms
- Require removal of non-compliant content
While we may monitor affiliate content, this does not shift responsibility for compliance from you to us. Consumer protection and advertising authorities can hold brands responsible for misleading affiliate content in some situations, so we take compliance seriously.
5.2 Permitted Channels
You may promote Copycat Cafe through:
- Your website, blog, or portfolio
- Email marketing to your own opted-in subscribers
- Social media channels you own or manage
- YouTube videos, podcasts, or other content you create
- Online courses or educational content
- Genuine reviews and recommendations
All promotional content must be honest, accurate, and comply with the disclosure requirements in Section 4.
6. Prohibited Activities
The following activities are strictly prohibited and will result in immediate termination and forfeiture of unpaid commissions:
6.1 Spam and Unsolicited Communications
- Sending unsolicited emails (spam)
- Posting affiliate links in unrelated forums, comments, or social media threads
- Any promotion that violates GDPR, ePrivacy, CAN-SPAM, or similar privacy, marketing, or anti-spam rules
6.2 Misleading or False Advertising
- Making false claims about Copycat Cafe or its features
- Creating fake reviews or testimonials
- Guaranteeing specific learning outcomes
- Misrepresenting pricing, features, or benefits
6.3 Brand and Trademark Violations
Restricted Terms means "Copycat Cafe", "CopycatCafe", "copycatcafe.com", "French Together", "frenchtogether.com", misspellings and close variants of any of these, and any of those terms combined with words such as coupon, discount, promo, code, deal, review, login, or pricing.
- Bidding on Restricted Terms on any ad platform, including Google, Bing, Meta, YouTube, or others
- Creating websites or social accounts that impersonate Copycat Cafe
- Using our logo, mascot, or branding without permission
- Registering domain names containing Restricted Terms
These rules apply to you and to any sites, accounts, businesses, or sub-affiliates you own or control.
6.4 Technical Fraud
- Cookie stuffing or forced clicks
- Self-referrals or referring fake accounts
- Using bots, scripts, or automated traffic
- Manipulating tracking codes or attribution
- Any activity designed to artificially inflate commissions
6.5 Incentivized Referrals
- Offering cashback, rebates, or incentives for purchases (without prior approval)
- Posting affiliate links on coupon or deal sites (without prior approval)
6.6 Paid Media Is Prohibited
You may not use Paid Media to promote Copycat Cafe or an Affiliate Link. This prohibition applies whether paid traffic goes directly to Copycat Cafe, passes through your own content, or passes through any other website, account, redirect, or intermediary.
- No paid search, shopping, social, display, native, video, retargeting, boosted posts, sponsored newsletter placements, or other paid traffic acquisition
- No Paid Media run by an agency, contractor, sub-affiliate, controlled account, or other person acting on your behalf
- No Paid Media to your own review, article, landing page, social profile, or other content when that journey promotes or links to Copycat Cafe
- No cloaking, referrer spoofing, or redirect chains that obscure where traffic came from
- Referrals and sales attributable to Paid Media are not Qualifying Sales and may be rejected or reversed, in addition to the remedies in Section 11
Advertising click identifiers: When an Affiliate Link contains a recognized advertising click identifier, including gclid, gbraid, wbraid, dclid, msclkid, or ttclid, we do not record or credit that affiliate referral. This applies even if the identifier was left in a URL accidentally. Before publishing or sharing an Affiliate Link, you are responsible for removing advertising click identifiers inherited from a link you copied, tested, or previously used in an advertising platform.
Technical detection is not the limit of this prohibition. Paid Media remains prohibited when an advertising platform removes, changes, or does not supply a click identifier.
6.7 Traffic Source Disclosure and Audit
Upon request, you must provide documentation of your traffic sources and promotional methods within 7 days. This may include analytics reports, referring URLs, keyword lists, ad-account records, creatives, invoices, and targeting settings needed to verify that no Paid Media was used. Failure to provide satisfactory documentation within 7 days is itself a material breach of these terms and grounds for withholding, reversing, or forfeiting commissions and terminating your participation.
7. Intellectual Property
Copycat Cafe™ is a trademark of Copycat Cafe Limited. The Copycat Cafe name, logo, mascot, and approved promotional materials may be used solely for the purpose of promoting Copycat Cafe as an affiliate and only in accordance with these terms.
You may not:
- Modify our logo or branding
- Create derivative works from our materials
- Imply official endorsement or partnership beyond the affiliate relationship
- Use our intellectual property after termination of this Agreement
8. Data Protection and Privacy
We take data protection seriously and comply with the EU General Data Protection Regulation (GDPR) and applicable Cyprus data protection law, including Law 125(I)/2018.
8.1 Data We Collect
We collect and process the following data about you as an affiliate:
- Name, email address, and payment details
- Information about your promotional methods and websites
- Referral and commission data
This data is processed for the purpose of administering the affiliate program. Our legal basis is contractual necessity (performance of this Agreement).
8.2 Your Obligations
If you collect any personal data in connection with your affiliate activities, you must:
- Comply with applicable data protection laws, including GDPR and other privacy laws where applicable
- Have a clear privacy policy on your website
- Obtain proper consent for any email marketing
- Not share Customer data with third parties
- Cookie consent: If your website uses cookies (including affiliate tracking cookies), you must comply with applicable cookie laws (including ePrivacy rules in the EU/UK where applicable) by obtaining proper consent from your visitors before non-essential cookies are set
8.3 Customer Data
You will not have access to Customer personal data. All Customer relationships are directly with Copycat Cafe.
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Program
- Our total liability to you shall not exceed the total commissions paid to you in the 12 months preceding the claim
- We are not responsible for technical failures, tracking errors, or third-party platform issues beyond our reasonable control
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Copycat Cafe Limited, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your breach of this Agreement
- Your promotional activities
- Your violation of any applicable laws or third-party rights
- Any content you create in connection with the Program
11. Term and Termination
11.1 Term
This Agreement begins when we approve your application and continues until terminated by either party.
11.2 Termination by You
You may terminate your participation at any time by contacting us at [email protected]. You will receive payment for any outstanding commissions above the minimum threshold.
11.3 Termination by Us
We may terminate your participation:
- Immediately for breach of Sections 4, 5, or 6 (Disclosure, Prohibited Activities)
- With 14 days' notice for any other reason, including discontinuation of the Program
11.4 Effect of Termination
Upon termination:
- You must immediately stop using all Affiliate Links and promotional materials
- You must remove or disable any Copycat Cafe promotions
- If terminated for cause, all unpaid commissions are forfeited
- If terminated without cause, we will pay any outstanding commissions above the minimum threshold
- Recurring commissions cease immediately upon termination
12. Changes to This Agreement
We may update these terms from time to time. For material changes (such as commission rate changes, payment terms, or prohibited activities), we will provide at least 30 days' notice via email before the changes take effect. For minor clarifications or formatting changes, we may update without prior notice.
Updated terms apply immediately to new applicants and newly approved affiliates. For existing affiliates, material changes apply after the email notice period.
The July 14, 2026 Paid Media prohibition applies immediately to applicants and affiliates approved on or after July 14, 2026. For affiliates approved before that date, it applies 30 days after we send the required email notice. It does not retroactively disqualify commissions validly earned before the applicable effective date.
Your continued participation after the notice period constitutes acceptance of the updated terms. If you do not agree to the changes, you may terminate your participation before they take effect.
13. Governing Law and Disputes
This Agreement is governed by and construed in accordance with the laws of Cyprus. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Cyprus.

14. General Provisions
- Entire Agreement: This Agreement constitutes the entire agreement between you and us regarding the Program
- Severability: If any provision is found invalid, the remaining provisions remain in effect
- No Waiver: Failure to enforce any right does not waive that right
- No Partnership: This Agreement does not create any employment, partnership, or agency relationship. You are an independent contractor and solely responsible for your own tax obligations
- Tax Responsibility: You are responsible for reporting and paying all taxes on commissions earned. Tax rules vary by country and may include income tax, social contributions, VAT, sales tax, or other obligations. We do not withhold taxes and will not provide tax advice—consult a qualified accountant for your situation
- Assignment: You may not assign your rights under this Agreement without our written consent
